SANDEEP Eknath Gaikar, a corporator belonging to Bhartiya Janta Party (BJP) in Kalyan – Dombivli Municipal Corporation (KDMC) is notorious for his alleged acts of illegal encroachment and capture of government lands. KDMC has now issued a notice to Gaikar in this regard, for his acts of illegal encroachment and illegal construction and has asked him for permission related documents pertaining to this illegal construction. In case Gaikar fails to come up with the documents, then the illegal construction work carried out by him will be razed and actions will be taken against Gaikar under MRTP Act. The corporation will file an FIR against him under the act, and he will be disqualified and removed from the post of corporator of KDMC.

On October 15, 2019 KDMC, under Maharashtra Mahanagar Palika Rules, u/s 260 and 267 (1) has issued a notice to Sandeep Eknath Gaikar. The notice was affixed on the site of illegal construction on October  17, 2019. The copy of said notice is available with Akela Bureau of Investigation (ABI).

Sandeep Gaikar is a corporator from Ward 29 of KDMC and was also the Chairman of Standing Committee. He has encroached a piece of Government Land located at Survey No – 64, near Indraprasth Society, Pawarni Pada, Kalyan (West). He has constructed rooms there and has rented those rooms out to various enterprises. They are Nizam Auto Garage, Mariam Auto Service, Krupa Service Centre, Gajanan Motors, Matoshree Motors, Matoshree Tyres, Manu Auto Repairs, G.S. Fabrication and Sahil enterprises.

Sandeep Gaikar has a long history of encroaching government land, and he has done this in the past as well several times. RTI Activist Vinay Pawar, after gaining information through RTI about illegal encroachment and construction on Survey No 64, had complained to KDMC against Sandeep Gaikar. That is the reason why KDMC has now asked Sandeep Gaikar to produce permission related documents about construction activities carried out by him. KDMC has in this regard, also given notices to Gaikar’s brothers Ravindra Gaikar and Devendra Gaikar. KDMC has also issued notices to the present occupants of the site, Munna, Manoj Jha, Bajirao Kaasaar, Mayur Kolhe, Sachin Sontakke etc. As per the notice, in case Gaikar, his brothers and the current occupants are unable to provide the relevant documents, then the illegal construction will be razed. Action will also be taken against Sandeep Gaikar, and FIR will be filed against him under MRTP Act. He may also be disqualified and removed as a corporator under Bombay Provincial Municipal Corporation Act (BPMC) u/s 10 (1) (d).

At present, Sandeep Gaikwar is busy soliciting votes for the Mahayuti’s candidate for current assembly elections. 

ABI View: Land Encroachment has become a serious menace of the society and for far too long, the authorities have turned a blind eye to it, often succumbing to political pressures. In the age of prolific Social Media, and with the rise of Social Activists, it is shocking that the concerned officials are still not aware about illegal encroachment and construction going on in their own backyard. In the above case, it took a complaint from Activist after filing RTI and then a complaint to KDMC. The question remains – why does KDMC not find out about illegal constructions in their area and take Suo-Moto action? Why wait for someone to complain? Strict action must be taken both against the Encroachers as well as errant Municipal Corporation Officers, under whose watchful eyes, such illegal constructions mushroom.
