IT HAPPENS ONLY IN ULHASNAGAR: everything is possible in Ulhasnagar. The Ulhasnagar Municipal Corporation (UMC) approved a plan on sheet number- 50 although plot is situated on sheet number-51. Not only this, UMC officials issued Completion Certificate (CC) after revealing in Bombay High Court that building was illegal.

Ulhasnagar-based advocate Deepak Mishra has exposed this illegality by complaining to several authorities. He has demanded strict action against the builder and as well as UMC officials. The complaint copy is available with ABI (Akela Bureau of Investigation).

The building in question is ‘Krishna Elita’ situated on block No-C-42, Room No-153-154 and E-2 CTS No- 9018, 9020, 30558 and Sheet No-50, Ulhasnagar-3 just under nose (100 meter away) of UMC headquarters. Earlier there was a bungalow. The builder Kishan K. Lahori demolished the bungalow and constructed ground plus seven stories RCC building following without any norms and acts.

Shocking happening
Acting on a PIL Bombay High Court ordered (copy with ABI) UMC authorities to carry out survey of unauthorised construction, submit report and take necessary action. Shockingly, on March 27, 2015 UMC authority submitted a report (copy with ABI) that construction had been completed and building had been slipped one meter back. After that instead of taking action UMC granted Completion Certificate.

“UMC authorities’ ne High Court mein accept kiya ki building thoda peechhe khisak gayi hai lekin action lene ke bajay CC grant kar di,” said Mishra.

There are several and naked violations of rules and acts in building but few are main-

1- Forged block area measurements/calculation of 89.55 Sq meters per floor and seven floor = 626.85 Sq meters.
2- Forgery in FSI calculation for eight balconies per floor.
3- Forgery in not calculation FSI of a shop of 22 Sq meters on the ground floor in the sanctioned plan.
4- WS area of entire building has been included into usable area and sold as salable area to the buyers.
5- Maximum permissible width of garage under the DC rules is 2.4 meters whereas a garage of 2.7 meters has been approved.
6- Mandatory ‘N’ line has deliberately not been shown in the sanctioned plan.
7- Required side margins distance for RCC building of seven floors as per the DC rules is 3.85 meters whereas the plan has been approved and sanctioned at 3.00 meters by the UMC TDP.
8- Mandatory drainage line is not shown in the sanctioned plan.
9- Mandatory area and location along with diagram for rain harvesting provision has been shown in the sanctioned plan nor has it been constructed.
10- The plot is situated in sheet no 51 whereas the plan has been approved in sheet no-50.

No value of MLA’s complaint
The local MLA Jyoti Kalani complained (copy with ABI) to the Chief Minister demanding action against builder under MCOCA act. Chief Minister also approved action but nothing happened. Sources said Jyoti Kalani complained because her former PA and now an influential leader Jeevan Idnani is a partner in the building. It is also reported that former BJP councilor Ram Parwani alias Charlie have 15 percent partnership in the building.

“Action should be taken on then town planner (TP) Hoge Patil, ADTP Milind Sonawane, JE Sanjay Pawar, current TP S M Karpe and builder Kishan Lahori,” said Mishra.
