JHUK GAYA AASMAAN: Notorious builder Vikas Oberoi famous with nickname as Vicky finally refunds money to a flat buyer Jagdish Bhai Patel. This is Vikas Oberoi who has taken oath that he is billionaire; he is capable to hold hundreds of flats but will never return money or flat to anyone.

On March 25, 2015 Jagdish Bhai Patel and Vikas Oberoi submitted settlement letter to Bombay High Court. On basis of that Bombay High Court disposed off the petition filed by Patel.

Advocate Vishal Kande appeared from Oberoi side into the matter.

“This is true Oberoi paid Rs. 2 crore by cheque and around Rs. 45 lakh (deposited in court with interest) cash to Jagdish Bhai Patel,’ said Santosh Pathak, on behalf of Jagdish Patel.

According to petition a Surat (Gujarat) based noted businessman Jagdish Bhai Kanjibhai Patel (48) has booked a flat (A-1003) in Oberoi Splendor, JVLR, Andheri (East) projects in 2007. Then flat cost was Rs. 1 crore and now about Rs. 4 crore. Even though Patel had paid half (50%) of the flat cost but suddenly Oberoi cancelled the flat without any prior demand letter.

Oberoi has adopted (always adopts) mischievous ideas to earn the money at the cost of innocent and gullible flat buyers. As the real estate market had gone high up he created dummy flat purchasers like-Rahul Suri and Ajit Rajnikant Pancholi- and used bogus sale purchase agreements.

Since dispute arose, Jagdish Bhai Patel filed suit (No-403/2012) against M/S Oberoi Reality and others. During the pendency of the suit Vikas Oberoi sold flat to one Rahul Suri (again controversial nephew of business tycoon Neeraj Kochar of Viraj industries a and as per information available on net Rahul Suri is prosecuted and convicted to one year imprisonment in the case of corporate espionage by Italian Court). Thereafter Rahul Suri sold the said flat to Ajit Rajnikant Pancholi of HSBC in sham and bogus transaction.

Acting on Patel’s suit, the Bombay High Court reserved another flat (E-806) of same cost -same area, in same project.

This is Vikas Oberoi who always claims that he is billionaire builder; he is capable to hold hundreds of flats. He also claims there are lots of lawyers on his pay role, who can manage the Bombay High Court Judges. He will never return money or flat to anyone. He claims that it takes decades for Civil cases to solve and no flat owner can sustain for such period, therefore his lawyers just keeping dates on frivolous grounds to frustrate litigants against him

‘Actually Vikas Oberoi settled the matter fearing adverse order and fear of arrest of his sham flat purchaser Ajit Rajnikant Pancholi (HSBC Bank Employee) in fake stamp paper scam. One day Mr. Vikas Oberoi will surely go behind bar, we are happy that Vikas found a match in Patel’ said one resident of Oberoi Splendor on condition of anonymity. Oberoi Splendor Owners are also victim of Oberoi and his habit of forging papers, misleading courts and other forums by twisting court orders.

What is Oberoi’s stamp paper scam?

At the behest of Vikas Oberoi 20 stamp papers- Rs 100 each- was purchased from Bombay High Court premises in May 2014. One of stamp papers was used for Ajit Rajnikant Pancholi. Actually the original stamp paper was on names of A A Lale and L A Lale. Oberoi’s and its accomplices  applied whitener on names of A A Lale and Ajit Rajnikant Pancholi came to be written on it. Not enough, the Pin-Code Mumbai-1 also changed to Borivali, Mumbai-92. The stamp paper purchase date was also changed using whitener. This stamp paper (tampered) was executed for Ajit Rajnikant Pancholi’s power of attorney dated May 2, 2014. The accused personated as Ajit Rajnikant Pancholi before the Notary and got the power of attorney notarised.

Some sources from M/S Oberoi Reality side leaked the counterfeiting of stamp papers to Jagdishbhai Kanjibhai Patel. The source also told that on particular date-when stamp paper was notarised – Ajit Rajnikant Pancholi was in Dubai and not in Mumbai, India. He left India on April 23, 2013.

Email was sent on behalf of Patel’s to Rajnikant Pancholi on his Hongkong bank’s email address demanding Xerox copy of Passport and Visa but Pancholi did not respond. On June 11, 2014 Pathak complained (copy available with ABI) against Pancholi in HSBC (Hongkong) bank demanding action.

Fearing legal action, Pancholi on June 19, 2014 gave an affidavit (copy available with ABI) to Bombay High Court that on particular date he was not in India. Also he has not signed any power of attorney in front of Notary. Pancholi also offered unconditional apology to Bombay High Court for his act. It means the affidavit was forged. The entire exercise of forgery was defended by Advocate Birendra Saraf, Ratnakar Mishra and Vikas Oberoi.

On January 8, 2015 the Division Bench of Bombay High Court Justices  Ranjit More and Justice Anuja Prabhudesai directed Mumbai Police to conduct an inquiry against fraudulent builder Vikas Oberoi and others who were involved in the offence of forgery of stamp paper. A controversial real estate developer Vikas Oberoi is accused of misguiding Bombay High Court and committing offences of cheating and forgery of valuable government security like stamp papers. A First Information Report (FIR) has been also filed against Vikas Oberoi for forging and cheating by flat owners in matter of the society formation and their money.

There should be certain rules & regulation between buyers & builders & some government notification that this property does not have any sort of problems with government stamped on it.

Khudos, there are many people who fall victim to builders fraudlent ways, many are afraid to go to court fearing long legal time consuming process, builders usually use this fear to lure innocent buyers. Our contry should have a strong legal support to flat buyers who can get their issues resolved immediately.
