HERE is a NOBLE example of illegalities in construction field as well as corruption in Brihanmumbai Municipal Corporation (BMC). A South Mumbai-based builder constructed 37 flats illegally at a place reserved for parking in six floors also more and more.
Shakeel Ahmed Khan, a resident of Char Null, Dongri has complained (copy with ABI) through legal firm H & M Legal Associates to various authorities demanding stringent action on Noble Tower built by Noble Constructions.
According to the complaint the 22 storey Noble Tower has been constructed at plot No- 1413, 1414 and 1415, 99/103, Mandvi division, Zakaria Masjid Street, Mumbai. It was a redevelopment of existing buildings.
Shakeel Khan (52) a transporter by profession is aware about illegalities of building. He is shocked and surprised to see the various illegalities and irregularities which are mentioned below:
1- Six parking floors duly constructed as per the approved plan i.e. basement plus five floors which was meant for 37 parking space has been converted into 1BHK flats.
2- The service floor constructed at the 6th floor too has been converted into residential premises.
3- Three refugee flats constructed at 8th, 15th and 20th floors have been sold out to various buyers.
4- Four flats have been constructed on the terrace sold out to various buyers, who have been illegally managed to procure electricity meters.
5- The space of the car lift and podium space has been illegally converted into a godown duly sold and occupied.
6- Finally the area provided for MTNL, society office, gymnasium too has been illegally converted into residential and commercial premises.
7- Building has no Intimation of Disapproval (IOD), Occupation Certificate (OC) and Commencement Certificate (CC).
8- The building has utilised the entire parking space illegally. It has become a nightmare and nuisance for the local residents, motorists and access to any heavy vehicle like ambulance and fire brigade has become impossible during distress.
Irresponsible BMC officials
Shakeel tried to obtain documents under RTI but BMC officials replied him in a very irresponsible manner. An official said that he had no file. Another said file was missing. One more official assured him to look into the matter. Most importantly, assistant engineer of B Ward Chandrakant Suryavanshi said, “What is the problem? Don’t come to my office repeatedly. If you have traffic problem it will be solved,” Shakeel quoted the official as saying.
“I have sufficient documents to prove that the building is totally illegal. This is NOBLE example for corruption in BMC and illegalities in real estate business,” said Shakeel.
