A Mumbai based businessman Millind H Kotak has accused an Ex Bhartiya Janata Party (BJP) Member of Legislative Assembly (MLA) from Ulhasnagar, Kumar Uttamchand Ailani of indulging in acts of criminal trespass by demolishing the bungalow and building several illegal structures, which predominantly consist of bamboo based structures on his family land at Lonavala in Pune district.

A resident of Ulhasnagar, Ailani is a businessman, builder, Ex-MLA from BJP party, Ex-Councilor and currently BJP Ulhasnagar’s District President. His wife, Meena Ailani, is currently the mayor of the Ulhasnagar. Ailani is also Director of Kumar Resort and Amusement Pvt. Ltd (KRAL) that owns Kumar Water Resorts at Lonavala and Matheran.

Kotak has complained to several authorities demanding two FIRs to be registered against Kumar Ailani, his son Dheeraj Ailani and others for offenses of criminal trespass, criminal conspiracy, cheating, forgery and other offenses under IPC and for the demolition of the above illegal structures on his family land.

According to the complaint dated August 8, 2017 (copy with ABI), Ailani has built illegal structures on the land, admeasuring 55 gunthas, which is valued at over Rs. 20 crores and demolished the bungalow admeasuring 5000 sq. ft. located at city survey No. 172, ward B, Lonavala on the Mumbai-Pune highway, next to the L & T training centre. This land is originally acquired by Manilal Harjivandas Kotak, the grandfather of Milind Kotak.

Kotak alleged that Kumar Ailani, his son Dheeraj, their companies and his uncle’s family members have not only executed two forged sale deeds with several false recitals but have also illegally got them registered and got their Index-II’s illegally issued with different property description and zoning with the intention of not only cheating his father’s branch of the family but also to cheat the state of its legally entitled revenue of stamp duty, which was done by them with the help of two ex-sub-registrars of Lonavala, namely Nandkar and Kavde, which was for the first time brought to the notice of several authorities by Kotak through his application dated June 6, 2016.

In the above application dated June 6, 2016, the office of the Inspector General of Registration (IGR) has directed his officials to impound the above two sale deeds, which was communicated by the IGR through letter dated July 12, 2016. Through order dated May 9, 2017, the office of the Joint Divisional Registrar (JDR), Pune Gramin has upheld the contention of the Sub-Registrar, Lonavala that an amount of nearly Rs. 2.65 lacs plus penalty at the rate of 2 % pm from 2010 onwards is payable by the company in which Dheeraj is a Director, which totals to nearly Rs. 4.5 lakh.

Kotak states: “As Kumar Ailani is annoyed with Kotak as his above legally valid applications have not only resulted in additional stamp duty liability and penalty thereon of nearly Rs. 35 lacs for his companies but have also resulted in the mutations arising from the two sale deeds his companies to be rejected, he has indulged in the acts of criminal trespass in his family land by demolishing the structure and building several illegal structures”.
