A Pune woman was left with no option but to herself become a lawyer when she experienced gross inaction, taunts and shoddy investigation on the part of the Government Railway Police (GRP) in a triple murder and rape case in which she lost her brother, sister-in-law and nephew. Till the end, the police claimed that the case was of either suicide or accident although it was a clear instance of gang rape and murder.

On December 21, 2016, the Tilak Nagar police in Dombivali (west), Thane district, Maharashtra, registered MECR (M-2) under sections 302 (murder), 376 (rape), 364 (A) (kidnapping for ransom), 120 (A) (B), (criminal conspiracy) 201 (causing disappearance of evidence of offence), 420 (cheating and dishonestly inducing delivery of property), 406 (criminal breach of trust), 504 (intentional insult with intent to provoke breach of the peace), 506 (criminal intimidation) of the IPC and section 3 of the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Act 2013. On a complaint from Pooja Chandram Dulbran (46), the police booked Vishwas Rajaram Madhvi, Alka Vishwas Madhvi, Kshitij Anand Podwal, Prashant Dattaram Raut, Sunil Hari Kokate and Prashant Bhimrao More. However, all accused are roaming free in the area.

On May 30, 2013, late at night, Ajit Chandram Singh, Savitri Ajit Singh and Ishwar Ajit Singh’s bodies were found on the tracks near Kopar railway station, Dombivali. At that time Pooja lived in Nalasopara. She rushed to the Dombivali GRP.

First day’s experience
On the first day, June 1, 2013, Pooja Dulbran experienced the inhuman face of the police. The then assistant commissioner of police (ACP) DM Pawar, the then senior inspector Mahesh Bagwe and other policemen told her that it was a clear case of either accident or suicide. Despite repeated requests, the police officials did not provide photographs, the panchnama report and the FIR copy to her. She approached the then GRP Commissioner Prabhat Kumar and on his instructions Pooja met DM Pawar. ACP Pawar did not care for his superior Prabhat Kumar’s instructions and refused to help Pooja. Pawar said to Pooja that the case was weak and she was better off dropping it and forgetting the whole thing. He is said to have advised her to take Rs 3 lakh to Rs 4 lakh compensation and keep mum.

“Pawar ne mujhse kaha ki case me dum nahin hai, teen-chaar lakh rupaye le lo aur chup baith jao,” said Pooja. Pawar and Bagwe even refused to give her the FIR copy. They gave her only the statement copy. Constable SR Kadam was two steps ahead, He always said, “Don’t teach us our duty.”

Are DM Pawar and Mahesh Bagwe blind?
This was a clear case of triple murder and group rape but DM Pawar and Mahesh Bagwe did not apply their minds. They were in much hurry to close the file. See how Pawar and Bagwe were blind by mind –
1- Four-year-old Ishwar’s body was fully naked. His head was crushed. Brain was removed and cotton was inserted. Iron nails were inserted in his chest.
2- Ajit Singh was in only underwear and baniyan.
3- Savitri’s body was half naked. Half of her body was found the second day near Diva railway station.

Can DM Pawar and Mahesh Bagwe answer the following?
1- If it were suicide, then why would the three members’s bodies be naked?
2- How Ishwar’s brain was removed and cotton inserted?
3- How iron nails were inserted in Ishwar’s chest after suicide?
Why Pawar and Bagwe did not believe Pooja’s claims that someone killed the trio and threw the bodies on the railway track is beyond understanding. Why did they not give an FIR copy to Pooja? Why was Bagwe in duch a hurry to close the file?

Their conclusion was, “Family members ki maut pe aisa hota hi hai.”

Finally, the shameless Mahesh Bagwe informed Pooja that her file has been closed. DM Pawar and Mahesh Bagwe were not doing their duty properly but were insulting and misbehaving with Pooja. She was a helpless woman at the time, and though disappointed she did not lost hope. She decided to fight. On suggestion from her family friends she wrote to the President, the Prime Minister, the Rail Minister, the Supreme Court, the High Court, the Chief Minister, the Home Minister and others. She was repeatedly complaining but nothing happened. It was then suggested by someone that she should approach the court through a lawyer.

Lawyer flees
Pooja met lawyer M R Tajane practising in the Kalyan court. Tajane himself proved to be an incompetent lawyer and an inhuman person. Tajane took his fees. On January 11, 2016, he filed the case and then forgot to attend court. He did not appear on three dates. In May suddenly he disappeared.

Fed up with DM Pawar, Mahesh Bagwe and M R Tajane’s behavior, Pooja decided to fight the case herself. She decided to become a lawyer. In July 2013, she took admission in SNDT law college, Mumbai, and completed the course in 2016. Now she is practising in a Pune court and also looking at the case in Kalyan court. On December 3, 2016, the magistrate ordered the registration of an FIR. Finally, on December 21, 2016, Tilak Nagar police registered the FIR. But Pooja’s problem did not end. She had to face Inspector (crime) R P Tiwari. Reason is not known, but R P Tiwari was not comfortable in registering the FIR. “Tiwari said to me, ‘Iss case me kuchh bhi nahin rakha hai’,” said Pooja.

R P Tiwari also refused to give her an FIR copy. Tiwari forced Pooja to leave the police station, saying, “Mera dimag mat khao.” After Pooja complained against Tiwari to Commissioner of Police Param Bir Singh, Tiwari gave a copy of the FIR to her. Recently, Pooja complained against Tiwari and sought necessary action as he was not following the Supreme Court and the DGP Maharashtra’s instructions that the FIR copy should be given to the complainant immediately.

Pooja Dulbran earlier was residing with brother Ajit at Arasha Bai building, Kopar Road, Dombivali (West). She is well aware that her brother’s family was in the clutches of a tantric, Vishwas Madhvi. There is strong reason to believe that he is the mastermind in the killings, but the police are not showing interest in taking action against him.

“Jo police mujhe FIR ki copy nahin de sakti to Madhvi ko arrest kaise karegi. Mera vishwas DM Pawar aur Mahesh Bagwe ki tarah R P Tiwari par se bhi uth gaya,” said Pooja.
