Hiral BHABHI gets 3-months imprisonment for assaulting her NANAD

THE Metropolitan Magistrate, 40th Court, Girgaon in Mumbai awarded three months simple imprisonment and fine of Rs 1,000 to a 38-year-old woman Hiral Pradeep Harsora for assaulting her sister-in-law Kusum Narottam Harsora (54). The court acquitted Pradeep Harsora and dropped the charge under section 327. If accused fails to deposit the amount of fine of Rs 1000, additional prison term of 10 days. Both sentences are to run consecutively.

On March 20, 2013 Hiral Harsora picked up a fight with Kusum Harsora. Hiral and her daughter hurled abuses and pushed and assaulted Kusum by slapping and punching her on nose, leading to bleeding. On April 18, 2013 Gamdevi police had registered FIR under section 323, 327, r/w 34 of IPC against Hiral Harsora, Pradeep Harsora and her daughter.

On February 28, 2020 Metropolitan Magistrate Mrs Anushree Rahane convicted Hiral Harsora under section 323 (voluntarily causing hurt) of Indian Penal Code and fine of Rs 1,000. Pradeep Harsora and his daughter were acquitted and section 327 was dropped into the matter.

Pradeep is a real brother (Bhai) and Hiral is sister-in-law (Bhabhi) of Kusum. Hiral, Pradeep and Kusum Harsora are a residents of Flat No- 41, Summer Villa, near Mahalaxmi Mandir, Bhulabhai Desai Road in South Mumbai. There is a dispute among the complainants and the accused with regards to estate of their deceased father and various litigations are pending before the city civil and criminal courts between the parties. Kusum Harsora has taken objection in probate proceeding being testamentary suit which is pending before Honourable Bombay High Court. Kusum Harsora has filed domestic violence case. A connected writ petition was also filed by Kusum. Ever since, Hiral and Pradeep were threatening Kusum to get her to withdraw the same. The real intention of the accused is to coerce the complainant to withdraw from her share in the property and to give into the illegal and unlawful demands of the accused. Pradeep has already unlawfully and illegally taken control of the various assets of the late father. The accused keep pressurizing and harassing Kusum to give up rights in the residential flat.

This reporter (Akela) was also made party into the matter for publishing assault news. Accused lawyer Dimple Shah and company tried to prove that news was fake on ground of that reporter was regular in touch with Kusum Harsora but failed. Magistrate was convinced that the news was published based on solid facts.

Kusum Harsora fought her case in person.
