SP Mahesh Patil, Addl SP Prashant Kadam and DySP Rajendra More

THE Superintendent of Police (SP) Dr. Mahesh Patil, Additional Superintendent of Police (Addl SP) Prashant Kadam, Deputy Superintendent of Police (DySP) Suhas Bavche, Deputy Superintendent of Police (DySP) Rajendra More, Deputy Superintendent of Police (DySP) B R Bhor and Police Inspectors (PI) Vyankat Andhale, Pradeep Kasbe all with the Thane Rural police may face action under atrocity act. These police officers intentionally avoided to arrest Ulhasnagar-based land mafia Prakash Budhrani although FIR was registered against him under Prevention of Atrocities (POA) Act, 1989.

National Commission for Scheduled Tribes (NCST) in New Delhi on October 8, 2017 issued notice to Mahesh Patil and Thane Collector demanding report on the issue. Copy of notice is available with ABI (Akela Bureau of Investigation).

Prakash Budhrani GANG have encroached on around 13-acres agricultural land  owned by scheduled tribal-Vitthal Laxman Shid and Suresh Soma Hindole at Vaghera Pada, Kamba, Taluka – Kalyan (West), District – Thane by forging documents. Budhrani illegally constructed a godown on 50,000 sq feet land of Shid’s plot, in an area reserved for mortuary. Shid being an illiterate has given power of attorney to Vishal Gupta, President of Parhit Charitable Society. After long battle on a complaint by Vitthal Shid on June 4, 2013 Titwala police registered FIR (copy with ABI) CR-I-125/2013 under sections 339, 341, 342, 193, 406, 401, 12 (B), 297, R/W 34 of IPC and sections 3 (I), (IV), (V), (VII), (IX), (XV) and sections 4,6,8 and sections 3 (2), (VI) and (XIV) of SCs and STs (prevention of atrocities act) Act 1989 and sections 7 (I) (A), to (D) of Protection of Civil Rights Act 1955 against Prakash Budhrani, gang members Nisha Budhrani, Vishal Budhrani, Sheetal Budhrani, Sudha Phadke, Prabhakar Agarkar, Alaknanda Natu, Anita Fadnis and Shantilal Poriya.

The FIR is registered under SCs and STs (Prevention of Atrocities) Act 1989 and Amendment Act 2015. As per POA act/rules the investigation should be done by SP level officer, accused should be arrested immediate and chargehseet should be submitted within one month and with permission of Superintendent of Police. But then police officers willfully neglected their duties and avoided to arrest the accused. Although there is no provision for anticipatory bail in SCs and STs (Prevention of Atrocities Act) but Prakash Budhrani fraudulently obtained anticipatory bail on December 16, 2013 from Kalyan court. Not only this, the Budhrani have breached the conditions of ABA and not remained present at the police station in a week on every Tuesday between 3 pm to 5pm till filing of chargesheet. “Titwala police and superiors were so kind with Budhrani as he paid minimum crores of bribes to them,” alleged Vishal Gupta.

Fed up with Titwala police’s behavior Vishal Gupta approached Honorable Bombay High Court (HC) demanding CID inquiry into the matter. On instruction of HC DySP, Mira Road division Suhas Bavche was appointed investigation officer. But matter became ‘three dhaak leaves.’ Bavche submitted C-summary report in Courts of Judicial Magistrate of First Class, Kalyan and Magistrate accepted the same.

Additional SP, DySP misbehaved

Additional Superintendent of Police, Thane Prashant Kadam in second week of September called the complainant along with other victims of atrocities Suresh Soma Hindole, Vishal Gupta, Santosh Pol, Vitthal Shid as well as two representatives/ social workers J P Shoke and Ramji Maheshwari but insulted them and refused to execute the special provision of POA act. “Jahaan jana hai jao, kuchh nahin hoga, Court ko kya jawab dena hai hum de denge,’ Kadam said to the complainants. On September 9, 2017 DySP Rajendra More also called the complainants at his Murbad office and he too insulted them similar to Kadam.

Having no option on September 18, 2017 Vitthal Shid filed case with Commission for Scheduled Tribes (NCST), New Delhi against Mahesh Patil, Rajendra More, Suhas Bavche, Vyankat Andhale, Prakash Budhrani, Nisha Budhrani, Vishal Budhrani and Sheetal Budhrani.

Since receiving NCST’s summon the officer’s mind disposed off. Their behavior has changed. At any cost they want to settle the matter and requesting/threatening complainants to withdraw the complaints it was civil in nature.

“Rajendra More and other police officials are not taking NCST’s notice seriously. They are talking politely and doing time pass only but I will not leave them without taking action on culprits,” said Gupta.

Main culprit is Vyankat Andhale

In another matter Suresh Soma Hindole had approached then senior inspector of Titwala police station Vyankat Andhale for registering the FIR against Budhrani gang under POA Act but Andhale avoided him. Shocking, Andhale ordered a police sub-inspector (PSI) to investigate the matter. According to Vishal Gupta Andhale is main culprit into the matter. He misguided his superiors like Dr Mahesh Patil. Vishal Gupta alleged Vyankat Andhale have taken lakhs of rupees from Budhrani and favoured him blindly. Andhale also blindly favoured notorious builder Poddar in another matter and took huge money on name of SP Dr Mahesh Patil.

This officers are so much currpt that they have spoil the life of myself common farmer. This currpt officers are always in a favour of land mafias.
