THE Thane District Consumer Disputes Redressel Forum (TDCRF) has ordered on Tuesday to a mother-son to pay compensation of Rs 4 lakh to DM Padvi, a flat buyer. The duo had failed to fulfill the conditions in the agreement to sale and provide him the tenement.

The complainant Padvi in his complaint stated before the forum that he had in 2008 purchased a flat at Kalyan owned by Sanjay Keshav More and Sunita Keshav More, for a consideration of Rs 8 lakh, and had made an initial payment of Rs 1.65 lakh for the same. As per the agreement the Mores were to get the housing loan standing on their name to the name of Padvi to enable him to get the loan from the bank.

In their orders, Forum President Umesh Jhavalikar and member ND Kadam have directed the duo to also refund a sum of Rs 1 lakh taken as advance from the complainant, within 75 days of the order, or else will pay the complainant a total amount of Rs 6 lakh (Rs 1 lakh extra) till the realization of the payment.

However it was revealed that the Mores had not got the flat transferred on their names from the original owner and there was a hitch in getting the loan transferred to Padvi.

Despite repeated reminders the Mores did not complete the formalities and get the documents for securing of the loan from the bank for the payment of balance amount of flat; it was stated in the complaint by Padvi.

On the other hand More argued that the complainant had not made any effort to get the papers on his name for securing the loan from the bank and hence the delay. (Agency).
