IT seems the words ILLEGAL, FAKE, SCAM, NOTORIOUS and BOGUS are made for Vikas Oberoi, the owner of Oberoi Reality construction firm. The Oberoi firm has already lost its credibility because of illegal construction and cheating of buyers. Now a bogus cooperative housing society (CHS) formed in Oberoi Splendor and supported by Vikas Oberoi has committed a fraud of Rs 25 crore.
The Oberoi Splendor project at JVLR, Andheri (East), constructed by Vikas Oberoi has proved to be most controversial. The Oberoi Splendor Flat Owners Association (OSFOA) are fighting an uphill battle against Oberoi Realty for constructing additional buildings PRISMA and GRANDE where there should have been open spaces or amenity space in gross violation of the law. Earlier all flat owners were fighting together against Vikas Oberoi. But Vikas Oberoi adopted the British tactic of ‘Divide and Rule’ and even got some success.
Oberoi got Splendor Complex Cooperative Housing Society (SCCHS) fraudulently registered in 2013. SCCHS included the illegal new high rise GRANDE. This society was registered by the builder in collusion with J D Patil, deputy registrar, who played a major role in forming the society with support of ghost politicians. Flat owners refused to accept the society in the first meeting held in June 2013 and the bank account opened in the name of society was frozen.
Suddenly, in September-October 2015, two-and-a-half years after registration and rejection by flat owners, claims were being made by a few flat owners that the society had been taken over by them and they started pestering and holding other flat owners hostage, by stopping entrance of residents into the building and threatening, harassing and defaming them. Bogus bank accounts were opened in HDFC Bank using the incorporation certificate of the society, which was with the builder and by making fake
resolutions. Dues payable by the builder were collected as arrears by issue of bogus bills as if the work of this committee was to be the recovery agent of the builder and to support the builder to cheat the flat owners further.
A Rs 25 crore fraud was committed by this bogus committee after extorting money from flat owners; they paid money to vendors of builder, builder payable service tax, property tax, etc, and awarded contracts on behalf of the bogus society without approval of the general body. Despite these major frauds, complaints to the registrar have fallen on deaf ears. The treasurer of this committee has himself written a letter to the registrar that the committee has been indulging in fraudulent acts which are not as per law, but the registrar prefers to keep his eyes closed as that office in Wadala seems to run as per the whims of Oberoi.
This committee tried to stamp and close it’s massive fraud with a bogus audit report, but flat owners rejected the audit report.
A flat owner Sudhir Agarwal said that the fraudulently registered society SCCHS was cancelled in 2014, but the co-operative minister stayed it after registrar chose to keep the cancellation order in secret for quite some time instead of acting on it immediately. After that, administrative authorities in collusion with the builder have kept passing perverse orders totally in oblivion to merits and therefore all trust of flat owners in the co-operation department is lost. On 14 August 2014, ABI published the matter as State cooperation minister Harshvardhan Patil passes ex-party order illegally favoring Oberoi builder.
Another flat owner T S Natrajan informed that due to complete loss of trust with the co-operation department, they have incorporated a company to take conveyance and be the association for the flat owners as per relevant provision of law. One more flat owner on condition of anonymity said that filing of criminal case against builder, registrar and this committee is being contemplated by many flat owners.
Questionnaires were sent to both, Oberoi and Deputy Registrar but no reply was received for comment

vikas oberoi is a cheat and a fraud and there is no doubt on that having been a flat owner of his construction company and been a victim of his fraudulent ways. a cheapo thug
