THE Bombay High Court on Wednesday rejected Anticipatory Bail Application (ABA) of Binu Verghese alias Kala Kauaa. The court observed that prima facie facts show his involvement in the offence.

On a complaint from Vishwanth Kelkar (then incharge of COVID hospital, TMC) on August 4, 2021, Kapurbawdi police station in Thane has registered an FIR (No- 241/2021) under sections 384, 385 and 34 of IPC against Binu Verghese alias Kala Kauaa. Earlier Thane court had also refused the anticipatory bail in the crime and ordered that Kala Kauaa be taken into custody and produced before the court.

Kala Kauaa applied for ABA (No- 2276/2021) in Bombay High Court through his lawyers SM Oak and Vinod Utekar. Mrs. JS Lohokare was the Public Prosecutor. On December 7, 2021 Honorable Justice Nitin W Sambre rejected his application stating that this court has earlier granted ad-interim protection in favour of the applicant (Kala Kauaa) on September 22, 2021 directing to cooperate in the investigation and be present as an when called by the Investigation Officer. The court observed that the Kala Kauaa had failed to observe the above instructions. Also, statement of witnesses, antecedents and other material prima facie facts depicts his involvement in the offences in question. “The complicity of the involvement of the applicant (Binu Verghese) can be inferred from the material available on record. As such, no case for bail is made out. Application stands rejected,” ordered the High Court.

Kala Kauaa alias Binu Verghese is a resident of Thane and is currently on the run. He is notorious as among the top Extortionist, Blackmailer, RTI Activist, Social Activist and fake Journalist in Thane district. Besides Kapurbawdi police station there are two more FIRs (extortion) that have been registered against him. Not only Binu Verghese his ‘Guru’ Jaspalsingh Walia alias Lovely is also absconding in extortion matter and ‘Chela’ Harrison D’Mello alias Hari Adhav was arrested in extortion case.
